1. Acceptance of Terms

By accessing or using Reputation Beam ("the Service"), operated by Reputation Beam ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Reputation Beam is an online reputation management platform that helps businesses collect, manage, and monitor customer reviews through automated SMS and email campaigns and a unified dashboard.

3. Account Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscriptions and Billing

The Service is offered on a subscription basis. By subscribing to a plan, you agree to pay the recurring fees associated with your selected plan. All fees are billed in advance on a monthly basis and are non-refundable except as required by law.

We reserve the right to change our pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Free Trial

We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial period ends. You will not be charged during the trial period.

6. Acceptable Use

You agree not to:

  • Use the Service to send unsolicited messages or spam
  • Violate any applicable laws, including TCPA, CAN-SPAM, and review platform terms of service
  • Use the Service to post fake, misleading, or incentivized reviews
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service in any way that could damage, disable, or impair the Service

7. SMS and Email Compliance

You are responsible for obtaining proper consent from your customers before sending SMS or email communications through the Service. You must comply with all applicable regulations including TCPA for SMS and CAN-SPAM for email. We provide tools to help you manage consent and opt-outs, but compliance is ultimately your responsibility.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Reputation Beam and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you submit through the Service.

9. Termination

We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. You may cancel your subscription at any time through your account settings.

10. Limitation of Liability

To the maximum extent permitted by law, Reputation Beam shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any material changes by posting the new terms on this page with an updated date. Your continued use of the Service after changes constitutes acceptance of the modified terms.
